Acceptance of Terms

By accessing or using Madrid Talk ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Madrid Talk.

Eligibility

You must be at least 18 years old to use Madrid Talk. By using the Service, you represent and warrant that you are 18 years of age or older. We reserve the right to refuse service to anyone for any reason, including age verification concerns.

Service Description

Madrid Talk provides a platform for random video and text chat with other users. The Service is provided "as is" without warranties of any kind. We do not guarantee continuous, uninterrupted, or secure access to the platform.

User Responsibilities

When using Madrid Talk, you agree to:

  • Provide accurate information if requested (though no registration is required)
  • Maintain the confidentiality of your session and not share it with unauthorized parties
  • Use the platform only for lawful purposes and in accordance with these Terms
  • Respect the privacy and rights of other users
  • Not attempt to circumvent platform security measures
  • Not upload viruses, malware, or other harmful code
  • Not harass, threaten, or intimidate other users

  • Not share graphic mature content or engage in sexually graphic conduct

Prohibited Activities

The following are strictly prohibited on Madrid Talk:

  • Harassment, hate speech, or discrimination based on race, religion, gender, sexual orientation, or nationality
  • Sharing or promoting illegal activities
  • Sharing personal identifying information of yourself or others
  • Commercial advertising without our prior consent
  • Impersonating others or entities
  • Using automated systems (bots) to access the Service
  • Attempting to gain unauthorized access to our systems
  • Any activity that violates applicable laws or regulations

Moderation & Enforcement

We employ automated systems and human moderators to enforce these Terms. Violations may result in:

  • Temporary or permanent account bans (where applicable)
  • IP address blocking
  • Report to law enforcement for illegal activities
  • Removal of content violating our policies

We strive for fair enforcement but reserve absolute discretion to take action as we see fit.

User Content

You retain ownership of content you create during chats. However, by using the Service, you grant Madrid Talk a limited license to use, process, and scan your content (video, audio, text) solely for moderation and safety purposes. This license ends when the content is deleted from our systems (typically immediately after session termination, except for temporary moderation analysis).

Intellectual Property

The Madrid Talk platform, including its design, logos, graphics, and software, is owned by us or our licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our permission.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MADRID TALK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE PAST TWELVE MONTHS.

Indemnification

You agree to indemnify and hold Madrid Talk harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and without prior notice. If you wish to stop using the Service, simply close your browser—no formal termination is required.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Madrid, Spain.

Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the new Terms. We will notify users of material changes via our blog or platform announcement.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
